§ 115-7. Penalty and continuing violations; persons liable; remedies cumulative; rule of procedure.

  • (a)

    Any person who violates any provisions contained in this chapter as originally adopted or hereafter amended or who fails to comply with any such provisions shall be guilty of a misdemeanor and, upon conviction therefor, shall be punished by a fine not to exceed $100.00.

    (b)

    The owner and each occupant of any land or any building or other structure thereon or any part thereof, any architect, builder, contractor, agent, employee or other person who commits, participates or assists in, allows or maintains any violation of any provision of this chapter as originally adopted or hereafter amended or who fails to comply with any such provisions shall likewise be guilty of a misdemeanor and punished as provided in subsection (a) of this section.

    (c)

    Each day any violation of or failure to comply with the provisions of this chapter as originally adopted or hereafter amended continues or occurs shall constitute a separate offense.

    (d)

    Nothing contained herein shall prevent the town from taking any other lawful action, including, but not limited to, the institution of any action at law or in equity, to prevent any violation of the provisions of this chapter as originally adopted or hereafter amended or to obtain compliance with such provisions.

    (e)

    In any action tried in the municipal court or any other court of competent jurisdiction, the complaint or pleading need not negate any exception contained in this chapter as originally adopted or hereafter amended, but the same may be raised by any party to such action by way of defense.
